The deal
Kallista (“we”) provides a software service that helps restaurants find catering customers and send personalized outreach emails. By using Kallista, you agree to these terms. If you don’t, don’t use it.
Your account
You need an account to use Kallista. You’re responsible for everything that happens on your account, including any emails sent from your connected mailbox.
You must be 18 or older. You must be authorized to act on behalf of the restaurant whose data and mailbox you connect.
What you may not do
- Send spam, deceptive emails, or content prohibited by the CAN-SPAM Act, GDPR, CASL, or any other law that applies to your recipients.
- Use Kallista for outreach in industries where cold email is prohibited (e.g., regulated medical or pharmaceutical recruitment in some jurisdictions).
- Misrepresent who you are. The connected mailbox must be one you legitimately operate; the restaurant profile must reflect a real business you are authorized to represent.
- Reverse-engineer, scrape, or attempt to extract bulk data from Kallista, including the prospect data we surface to you.
- Resell, sublicense, or share access to your account.
Outreach you authorize
Kallista drafts emails using AI. You are the sender of record for everything sent from your connected mailbox. You are responsible for the content, the recipients, and any consequences (replies, unsubscribes, complaints, regulator inquiries).
Kallista’s pre-send evaluator and the daily-cap enforcement help reduce risk but do not transfer responsibility from you to us.
Trial and billing
New accounts include a free trial limited to a fixed number of email sends. After the trial, continued sending requires a paid subscription. We may change pricing with 30 days’ notice for existing subscribers.
Subscriptions renew automatically until you cancel from the billing settings. We do not offer pro-rated refunds for partial months, except as required by law.
Service availability
We try to keep Kallista running, but we don’t guarantee uptime. Planned maintenance is announced when possible. Unplanned outages happen.
Termination
You can close your account at any time from billing settings. We can suspend or terminate your account for material violation of these terms (notably: spam, fraud, or providing false business information), with notice when practical and immediately when not.
On termination, your data is deleted per the Privacy Policy.
Disclaimers and liability
The service is provided “as is.” We disclaim all implied warranties to the extent allowed by law. We are not liable for indirect or consequential damages. Our total liability for any claim related to Kallista is capped at the amount you paid us in the 12 months preceding the claim.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes are heard in the state or federal courts of Delaware.
Changes
We may update these terms. Material changes will be communicated via email before they take effect. Continued use after the effective date constitutes acceptance.
